Aguirre, caught by camera, mulls action vs. Hontiveros

Justice Secretary Vitaliano Aguirre II is mulling taking legal action against Senator Risa Hontiveros and others who took photographs of his private text messages.

“I am considering all my options open,” the Secretary pointed out in statement.

“I could file criminal, civil and administrative cases against all persons responsible,” he warned.

During her privilege speech on Monday, Hontiveros called on Aguirre to resign for plotting against her and other members of the opposition.

The Senator cited as proof the screen shot a photographer took of the text message exchanges Aguirre was having on his mobile phone with former Negros Oriental Rep. Jacinto (Jing) Paras.

Aguirre said the photo which was taken during his appearance at the September 5 hearing of the Senate’s committee on Public Order and Dangerous Drugs is “illegal and betrays the Constitution.”

The Secretary pointed out “the right to privacy of communication is a constitutionally guaranteed right under Article III of the 1987 Constitution.”

“The act of unauthorized prying into an exchange of private text messages and the subsequent act of making it very public, also without authority, is a flagrant violation of Republic Act no. 4200 or the Anti-Wire Tapping Act,” he also cited.
